The petitioner seeks bail in Ghorasahan (Lakhaura) P.S. case No. 263 of 2014 under Section 147, 149, 342, 323, 379, 504, 506, 457 and 380 of the Indian Penal Code. The informant named 13 persons and alleged that they along with some unknown persons came to the house of informant and they were pressurizing the informant to compromise the case of murder of her son. The accused persons looted away different articles.
The learned counsel for the petitioner submits that no specific allegation is made against the petitioner. Similarly situated accused Shambhu Sah and Sabha Rai have already been
Patna High Court Cr.Misc. No.55417 of 2016 (4) dt.17-03-2017 2/2 granted bail vide order dated 29.03.2016 passed in Cr. Misc. No. 9168 of 2016. Of course, the petitioner has got criminal antecedent but he is jail since 30.01.2016 and he has already remained in jail for more than 14 months.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sikarahana at Dhaka, East Champaran in Ghorasahan (Lakhaura) P.S. Case No. 263 of 2014, G.R. No. 1099 of 2014, subject to condition that one of the bailors shall be close relative of the petitioner.
