NILU AGRAWAL ORAL ORDER 04-12-2018 Heard learned counsel for the petitioner, learned counsel appearing on behalf of the State as well as learned counsel appearing on behalf of the Accountant General, Bihar, Patna.

The petitioner retired from the post of Agricultural Extension Officer on 27.12.2001.

In the present writ application, he prays for fixation of monthly pension on the basis of first and second ACP granted to him way back in the year 2008 vide letter No. 5682 dated 01.08.2008, as contained in Annexure- 4 by which the petitioner, who is at serial No. 73, has been granted benefit of 1st

Patna High Court CWJC No.1357 of 2018(3) dt.04-12-2018 2/2 and 2nd A.C.P. but his pension has not been revised accordingly. He also prays for arrears of dues Rs. 9496/-, which was sanctioned by Accountant General Office, as contained in Annexure -1, which is dues amount of leave encashment which the petitioner has not yet received.

Considering the nature of prayer of the petitioner, the writ application is disposed of with a direction to the petitioner to file a representation before the respondent No. 2, which will be disposed of by the Respondent No. 2 within a period of two months from the date of filing of such representation by a speaking order communicated to the petitioner by registered post. If any dues and interest is found admissible the same shall be paid within one month thereafter. .
