The petitioner seeks bail in a case registered for the offence under Section 302 / 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, co-accused Upendra Rai and Satendra Rai shot the deceased at her both thigh and face, as a result of which, she died.

Petitioner is neither named in the F.I.R. nor there is any allegation of overt act against him. Name of the petitioner has transpired during course of investigation. From bare perusal of the F.I.R., it is apparent that specific allegation of firing is against co-accused Upendra Rai and Satendra Rai, who were pressurizing the deceased to compromise the cases, which were earlier filed by her, and so far as this petitioner is concerned, he has been made accused in this case only because he is brotherin-law of co-accused Upendra Rai and he is in custody since

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IX, Saran at Chapra in connection with Parsa P.S.
