2. The petitioner apprehends his arrest in connection with Khalgaon P.S. Case No.853 of 2021 dated 11.12.2021 for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 504 & 506 IPC, pending in the Court of learned C.J.M., Bhagalpur.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is accorded.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within six weeks from today and seeks

Patna High Court CR. MISC. No.53354 of 2023(2) dt.16-08-2023 2/2 regular bail, the learned Court below would pass order on the same day in accordance with law considering the fact that a compromise has already been entered into between the parties and a copy of the compromise petition has been annexed as Annexure-5 to this application as also the fact that the injury is on the non-vital part.
