Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 420, 188 and 34 of the Indian Penal Code, registered in connection with Piprahi P.S.Case No. 33 of 2016.

As per allegation, the petitioner, who was Panchayat Secretary, did not supply relevant papers to the Inquiry Committee at the relevant time.

The learned counsel for the petitioner has submitted that he is innocent and he had submitted all the papers at that time and that he was transferred in the Block in the year 2005 itself.

On the other hand, the learned APP has opposed the

Patna High Court CR. MISC. No.52537 of 2022(2) dt.24-01-2023 2/2 prayer for bail.

It appears that on similar footing co-accused Lal Babu Prasad Yadav and Ram Vinay Singh have been granted anticipatory bail by a co-ordinate Bench of this Court. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri Manish Kumar, J.M. 1st Class, Sheohar in connection with Piprahi P.S.Case No. 33 of 2016, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
