JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 24-08-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner seeks bail in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
The informant Sunil Singh, father of the deceased, alleged that on 13.05.2019, Raushan Kumar came to his house and called his son for playing cricket. Some altercation took place between Raushan Kumar and Pushkar Kumar, the deceased. Raushan Kumar called Ashok Singh and the petitioner. Ashok Singh ordered to kill Pushkar Kumar. Thereafter Ranjay Kumar and Ashok Singh caught hold Pushkar
Patna High Court CR. MISC. No.11531 of 2021(3) dt.24-08-2021 2/2 Kumar and Raushan Kumar assaulted Pushkar Kumar by means of wicket on his head due to which the son of the informant sustained injury on his head and succumbed to the injury. Learned counsel for the petitioner submits that there is specific allegation of assault against Raushan Kumar. The only allegation against the petitioner and Ashok Singh is that they caught hold Pushkar Kumar, the deceased. The petitioner has got no criminal antecedent as mentioned in para 3 of the bail petition and he is in custody since 17.10.2020. In the aforesaid facts and circumstances of the case and the fact that the petitioner is only said to have caught hold the deceased, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned court below/successor court where the case is pending in connection with Hajipur Sadar P.S. Case No.313 of 2019.
