JUSTICE DHARNIDHAR JHA ORAL ORDER 27-02-2015 After having heard Sri Kanhaiya Prasad Singh, learned senior counsel on behalf of the petitioner, the Court is of the opinion that no extraneous materials other than the materials which was perused by the learned Additional Sessions Judge-XI, Patna in Special Case No.69 of 2009 could be taken into account so as to judging the merit of an order passed under Sections 227 and 228 Cr.P.C. For discharging the accused, the Court is required to assign reasons but that may not be the case when he had decided to pass an order directing the framing of charges. The learned counsel was brining into my notice some of the orders passed by authorities, like, the State Human Rights Commission but as noted above, it will be too early to peruse that document as that may be utilized by the petitioner as a defence in his favour in due course of the trial.

Patna High Court Cr.Misc. No.12145 of 2012 (16) dt.27-02-2015 Finding no merit in the petition, the same is dismissed with the direction to the court to take up the hearing of the trial expeditiously.

If an order of stay had ever been granted by this Court that shall stand vacated.
