Petitioner seeks bail in a case registered under section 302/34 of the Indian Penal Code, 27 of the Arms Act and 17 CLA Act. Petitioner is not named in the first information report but it appears that the name of the petitioner came in this case in the confessional statement of co- accused and after that informant expressed her doubt against the petitioner. Charge sheet against the petitioner has already been submitted.

No doubt, alleged occurrence is said to have taken place in the year 2006 and the petitioner could be remanded in this case on 31.10.2015 but there is nothing in the impugned order that the petitioner voluntarily evaded his arrest.

Moreover, some co-accused have already been granted privilege of bail whereas some other have been acquitted by the trial

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge II, Aurangabad in Sessions Trial no. 131A of 2008/ 75 of 2016 arising out of Amba P.S. Case no. 31/2006.
