20-09-2018 Heard Sri N.A. Shamsi, learned counsel assisted by Mr. Syed Ehteshamuddin, learned counsel for the petitioners and Sri Kumar Virendra Narayan, learned Addl. Public Prosecutor.
Two petitioners, apprehending their arrest in Baisi P.S. Case No. 95 of 2018 registered for offence under Section 7 of the Essential Commodities Act, 1955, have prayed for grant of bail in the event of their arrest or surrender. Learned counsel for the petitioners, by way of referring to F.I.R., submits that without any basis petitioners have been made accused.
Besides hearing, I have also perused the F.I.R. and
Patna High Court Cr.Misc. No.58780 of 2018(2) dt.20-09-2018 2/2 after going through the same and considering the nature of accusation, I am of the opinion that it is a fit case for grant of anticipatory bail.
Accordingly, in the event of their arrest or surrender within a period of six weeks from today, let aforesaid two petitioners namely (i)Md. Hejaj Alam and (ii) Wasim Raza @ Md. Wasim Raja be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Purnea in connection with Baisi P.S. Case No. 95 of 2018 (G.R. No. 1268 of 2018), subject to condition as laid down under Section 438(2) of the Cr.P.C.
