Vide a detailed order dated 20.12.2021, the petitioner was granted provisional bail and O.P. No.2 was directed to bring on record the documents to demonstrate that he had paid Rs. Sixteen Lakhs to the petitioner.
A counter affidavit filed by O.P. No.2 is on record in which he has enclosed the documents showing that the petitioner has taken Rs. Sixteen Lakhs from opposite party no.2 but the petitioner is not ready to return the aforesaid amount. It is also pertinent to mention here that this case was referred for mediation and mediation failed.
In that view of the matter, order dated 20.12.2021
Patna High Court CR. MISC. No.9395 of 2021(5) dt.28-06-2022 2/2 granting provisional bail to the petitioner is hereby recalled and the petitioner is directed to surrender before the learned court below within four weeks from today and seek regular bail. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Complaint Case No.195C/2019 pending before the Judicial Magistrate 1st Class, Buxar is rejected.
