====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 29-07-2026 Heard learned counsel for the petitioner and learned APP for the State. Learned counsel for the informant appeared suo-moto in this case.

2. The petitioner apprehends arrest in connection with Mahila P.S. Case No. 14 of 2026 lodged on 22.04.2026, for the offence punishable under Sections 64, 352 & 351(2) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution, FIR has been lodged against the sole petitioner with allegation that in the night at about 12 'o' clock when the informant was sleeping, the petitioner entered in her room and committed rape with her. Upon oppose,

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that from the FIR itself, it become crystal clear that the informant and petitioner both are adjacent neighbours and the informant is aged about 32 years and the petitioner is aged about 24 years. Counsel submits that the informant has refused for her medical and X-ray examination. The copy of the same is annexed here as Annexure-P/2. He submits that the present FIR has been lodged against the petitioner with ulterior motive. He further submits that the petitioner has one criminal antecedent in which he is on bail.

5. Learned counsel for the informant vehemently opposes the prayer for bail and submits that as per the FIR, it has been specifically alleged that the petitioner has committed rape with the informant.

6. Upon the specific query of this Court from the counsel for the informant that why the informant has refused for her medical examination, counsel for the informant has no answer in this regard.

7. Learned APP for the State also opposes the prayer

Patna High Court CR. MISC. No.52397 of 2026(2) dt.29-07-2026 3/3 for bail of the petitioner but fairly submits that the medical and X-ray examination was denied/refused by the informant.

As such, in the present facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of S.D.J.M., Purnea, in connection with Mahila P.S. Case No. 14 of 2026, subject to the conditions as laid down U/s 482(2) of the B.N.S.S., 2023.
