This modification petition has been filed on behalf of petitioner Indrashan Sah for modification of order dated 23-082016 passed in Cr. Misc. No. 34994 of 2016. Learned counsel for the petitioner submits that the petitioner was made accused in Nautan (Jagdishpur) P.S. Case No. 64 of 2016 and in formal FIR, his father's name was given as Tulsi Sah. Accordingly, Cr. Misc. No. 34994 of 2016 was filed on behalf of the petitioner giving his father's named as Tulsi Sah but police after investigation, submitted charge sheet against the petitioner and others in the above-said case and in the charge sheet, the father's name of the petitioner was given as Shankar Sah and that is why, the petitioner filed this modification petition to add alias name of his father as Shankar Sah.

In view of the aforesaid submission, this modification

Patna High Court Cr.Misc. No.50673 of 2016 (2) dt.23-11-2016 2/2 petition is allowed and the petitioner is permitted to add alias name of his father as Late Shankar Sah in cause, title of the petition of Cr. Misc. No. 34994 of 2016.

Accordingly, the order dated 23-08-2016 passed in Cr. Misc. No. 34994 of 2016 is modified to the extent that in the cause, title of the order the alias name of the petitioner as Late Shankar Sah be also read. All the other terms and conditions shall remain be same in mentioned in the above-said order dated 23-082016. (Hemant Kumar Srivastava, J) A.K.V./- U T
