JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Jadia P.S. Case No. 105 of 2018 registered for the offences punishable under Sections 341, 323, 353, 504, 506, 34 of the Indian Penal Code.

The informant claims that when he apprehended the accused of Jadia P.S Case No. 98 of 2018, the petitioners and several others made protest and misbehaved with him and other police officials.

Submission on behalf of the petitioners is that the accused of Jadia P.S Case No. 98 of 2018, namely, Sanjay Ram @

Patna High Court Cr.Misc. No.60488 of 2018 (2) dt.06-10-2018 2/2 Sanjeet Ram had come to attend Shradh ceremony of father of petitioner no. 3 and police arrested him and after that petitioners and several other villagers requested the informant and other police officials to wait till completion of Shradh ceremony but informant lodged this false case against the petitioners and others. Para 3 of the petition goes to show that petitioners do not have any criminal antecedent and no specific overt-act has been attributed against the petitioners.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Supaul in Jadia P.S. Case No. 105 of 2018 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
