The opposite party No. 2, Assistant Sub-Inspector has filed counter affidavit through learned Spl. PP acknowledging the fact that he has due notice of the instant proceedings for modification of the order dated 28.06.2021 passed in Cr. Appeal (SJ) No. 1714 of 2021.

The learned counsel for the petitioner submits that the name of the petitioner's father has wrongly been written as 'Vishwa Nath Singh' instead of 'Shivnath Singh' due to inadvertence. The prayer is that such typographical error regarding the name of petitioner's father mentioned in the order dated 28.06.2021 passed in Cr. App. (SJ) No. 1714 of 2021 may

Patna High Court CR. MISC. No.63616 of 2021(7) dt.09-02-2022 2/2 be corrected/modified, so as to enable the petitioner to avail the benefits of the said order.

In view of the aforesaid submissions, the Court would direct that the name of the petitioner's father be read as Vishwa Nath Singh alias Shivnath Singh in the order dated 28.06.2021 passed in Cr. App (SJ) No. 1714 of 2021.

The order stands modified.
