The petitioner, who is in custody, seeks bail in connection with Tribeniganj P.S. Case No. 246 of 2018 registered for the offence punishable under Section 414 of the Indian Penal Code.
FIR has been lodged on the basis of written application filed by one Manish Kumar, Sub Inspector of police, in which he stated that during patrolling he saw a person sitting over a motor bike containing no number and seeing the police team started fleeing away with motor bike but the police team nabbed him whereupon he disclosed his name as Md. Sallauddin (petitioner) and confessed to have stolen motorcycle from the adjacent premises of Banmankhi State Bank of India branch.
Patna High Court Cr.Misc. No.60795 of 2018(2) dt.11-10-2018 2/2 It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated merely on suspicion. It has been further submitted that said motorcycle bearing no registration number but in its dicky his ID card and acknowledgment was available. It has been further submitted that running of motorcycle without registration number does not make out any offence under the Indian Penal Code. Petitioner has no criminal antecedent and he is in custody since 26.06.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-1st, Suapul, in connection with Tribeniganj P.S. Case No. 246 of 2018.
