JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-11-2019 The petitioner seeks bail in connection with Sour Bazar P.S. Case No. 510 of 2018, dated 06.09.2018, instituted for the offences under Sections 302, 201 and 34 of the Indian Penal Code.

The informant has alleged that because of old enmity, one Ram Swaroop Sada, Sanjay Sada and the petitioner took away the father of the informant while he was sleeping in his house. The dead-body of the father of

Learned counsel for the petitioner has submitted that because of old enmity, the petitioner and other accused persons have been named in this case. There is no eyewitness to the occurrence. It has further been submitted that the father of the informant was taken away from his house on 04.09.2018, but no case was lodged with regard to such abduction. The case has been lodged only on 06.09.2018, when the dead-body of the father of the informant was found. No positive evidence could be collected during the course of investigation. The petitioner is in custody since 30.12.2018. Under similar circumstances, one of co-accused persons, viz., Ram Swaroop Sada has been released on bail by a co-ordinate Bench of this Court vide order dated 30.04.2019 passed in Cr. Misc. No. 10224 of 2019. Considering the aforestated facts and the period of custody of the petitioner above named, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of
