====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-01-2021 The present writ petition has been filed seeking the following reliefs:- i. The respondents may be directed to ensure immediate consolidation cum Revision of pay/ pension and other consequential benefits in view of the Govt. Resolution no. 11558 dated 22.12.99 (Annexure-2 page 15).
ii. The respondents also may be directed to refix all the post retiral dues on the basis of payable pay scale so be found admissible from the due date of entitlement.
Patna High Court CWJC No.17963 of 2019(5) dt.28-01-2021 2/2 iii. The respondents also may kindly be directed to roaster the admissible pay scale/ pension etc. and refund the gratuity amount so recovered unilaterally without any show cause.
The learned counsel for the petitioner submits that the petitioner be granted liberty to approach the respondent no.2 i.e. the Director, Primary Education, Govt. of Bihar, Patna for redressal of his aforesaid grievances.
Accordingly, the present writ petition stands disposed of with liberty to the petitioner to approach the respondent no. 2 by filing appropriate representation within a period of four weeks from today, whereupon the respondent no.2 shall consider the same in accordance with law and dispose of the same by a reasoned and a speaking order within a period of eight weeks thereafter.
It goes without saying that the admissible dues, if any, shall be paid by the respondent no. 2 forthwith. (Mohit Kumar Shah, J) Tiwary/- U
