JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,406,467 and 468 of the Indian Penal Code.

It is alleged that the complainant purchased a Bolero vehicle from one of his relatives Sandeep Kumar and paid Rs.7,26,000/-. Subsequently, the vehicle was seized from the complainant by the financer as the same was hypothecated and the owner defaulted in repayment of loan. The accused persons subsequently gave his tractor to the complainant on the undertaking that till the return of the amount he will use the tractor. It is alleged against the petitioner that the petitioner and one Baliraj Sahni mediated the dispute.

Considering the thrust of accusation against co accused Sandeep Sahni, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari East Champaran in connection with Complaint Case No. C-877 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
