JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 13.07.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Sabour (Goradih) P. S. case no. 39/2015 registered under sections 376, 366A and 504/34 of the Indian Penal Code. It would appear from perusal of the first information report that entire allegation of kidnapping centers around against co-accused Mritunjay Madal and so far as petitioners are concerned, it is only stated that they made a proposal for marriage of the informant with co-accused Mritunjay Madal and when the aforesaid proposal was turned down by father of the informant, petitioners abused him.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.24509 of 2015 (2) dt.13-07-2015 well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Ist Addl. Sessions Judge, Bhagalpur in Sabour (Goradih) P. S. case no. 39/2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
