The petitioners seek bail in anticipation of their arrest in connection with Bagaha P.S. Case No. 183 of 2019 instituted for the offences under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2016.

15 litres of locally brewed liquor was found kept in the dickey of two motorcycles. One of the persons riding those motorcycles was arrested and the prosecution of the petitioners in this case is only on the basis of statement

Patna High Court CR. MISC. No.8658 of 2021(2) dt.15-03-2021 2/2 made by the aforesaid arrested person.

The petitioners have clean antecedents and nothing has been recovered from their possession.

Considering the afore-stated facts, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran, in connection with Bagaha P.S. Case No. 183 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
