20-09-2018 Heard Sri Basant Kumar Singh, learned counsel for the petitioner and Sri Kumar Virendra Narayan, learned Addl. Public Prosecutor.
The sole petitioner, who is P.D.S. dealer, apprehending his arrest in Awtar Nagar P.S. Case No. 74 of 2018 registered for offence under Section 7 of the Essential Commodities Act, 1955, has prayed for grant of anticipatory bail.
Learned counsel for the petitioner submits that petitioner has been made accused only on accusation that at the time of inspection, his P.D.S shop was found to be closed. Be that as it may, considering the nature of accusation, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely
Patna High Court Cr.Misc. No.58689 of 2018(2) dt.20-09-2018 2/2 Kameshwar Prasad Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Saran at Chapra in connection with Awtar Nagar P.S. Case No. 74 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
