JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Six persons including the petitioner, who happens to be a lady, are named in the first information report with accusation that they assaulted the informant's father by means of lathi and danda and subsequently, the informant's father died in course of treatment.
Submission on behalf of the petitioner is that the post mortem report of the deceased goes to show that only one injury was found on the person of the deceased.
