====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 28-09-2018 Heard Sri Vijay Kumar, learned counsel for the petitioner and Sri Shailendra Kumar Singh, learned Additional Public Prosecutor.
The sole petitioner, apprehending his arrest in connection with Chapra Town P.S. Case No. 281 of 2018, registered for the offence under Section 341/323/324/307/34/147/148/149 of the Indian Penal Code, 1860 and Section 27 of the Arms Act, 1959, has prayed for grant of bail in the event of his arrest or surrender. Learned counsel for the petitioner by way of referring to the F.I.R. submits that save and except the fact that petitioner was arrayed as member of unlawful assembly, there is no other allegation of overt act , and as such, petitioner is entitled to be released on anticipatory bail, however, on going through
Patna High Court Cr.Misc. No.60119 of 2018(2) dt.28-09-2018 2/2 the F.I.R. , I do not find any ground to pass favourable order. The prayer for grant of anticipatory bail stands dismissed.
