JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

This is an application for grant of regular bail for offences punishable under Sections 147, 148, 149 and 307 of the Indian Penal Code and Section 27 of the Arms Act. It has been submitted on behalf of the petitioner that there is case and counter case between the parties and from the perusal of the First Information Report, it appears that no injury has been caused to anyone. It is further submitted that present case has been lodged only in retaliation of the case filed by the petitioner being Salukha P.S. Case No. 209 of 2016, against the informant side. It has further been submitted that the petitioner has no criminal antecedent and he has been in judicial custody since 08.11.2016. Heard learned A.P.P. also.

No.54747 of 2016 (2) dt.20-12-2016 2/2 Having heard bother sides and in view of the fact that though the allegation of assault has been levelled against the petitioner, no injury has been caused to anyone and petitioner has no criminal antecedent and has been in judicial custody since 08.11.2016, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M -II, Saharsa, in connection with Salukha P.S. Case No. 208 of 2016.
