JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 354, 448 and 379 of the Indian Penal Code. It is alleged against the petitioner that he and other accused persons came and asked the informant's side to vacate the land in question when on protest being made, the petitioner inflicted injury on the head of Puja Kumari with farsa and when the informant and his wife came to rescue, they were also assaulted when other accused persons took away cash and ornament.

It is submitted by learned counsel for the petitioner that injury report of Puja Kumari suggests only one lacerated simple

Patna High Court Cr.Misc. No.19308 of 2015 (3) dt.19-05-2015 2/2 injury caused by hard and blunt substance. A statement has been made in para 7 of the petition that there is no injury report of the informant and his wife on record. Title Suit No. 178 of 1993 is pending between the parties from before and there is counter version of the occurrence also. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., Saran, Chapra in connection with Khaira P.S. Case No. 33 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
