Petitioner seeks bail in connection with Barauni (Chakiya) P.S. Case No. 250 of 2016 registered under Sections307, 414 of the Indian Penal Code and sections 25(1-B)a, 26, 35 and 27 of the Arms Act.
Petitioner was caught on the spot with a loaded country made pistol while picking out copper by burning cable. Learned counsel for the petitioner submits that petitioner is innocent and has been implicated in this case at the instance of his enemies. No body has claimed the recovered materials.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner has criminal
Patna High Court Cr.Misc. No.49660 of 2016 (4) dt.09-02-2017 2/2 history and was apprehended on the spot with loaded pistol. Considering the facts and circumstances of the case and the submissions advanced on behalf of the State, I do not feel inclined to grant the privilege of bail to the petitioner. His prayer for bail is, therefore, rejected.
However, petitioner may renew his prayer for bail after framing of charge.
