JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 02-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

As per prosecution case, one person came on Scooty and called out Bachu, a young man came out from the house and sat over Scooty. The aforesaid Scooty while covering some distance met with another person, who fired in the air. It is said that the persons having over Scooty had disclosed that there will be further firing. From the order impugned, it is evident that firings were made in the air without causing injury to any person. Furthermore, it is evident that petitioner has got criminal antecedent.

Be that as it may, considering the nature of allegation in consonance with the period of detention since 25.07.2016,

Patna High Court Cr.Misc. No.52078 of 2016 (02) dt.02-12-2016 petitioner, Bachu Sonar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P. S. Case No.322 of 2016.
