Petitioner seeks bail in Laukahi P.S. Case No.210 of 2017 instituted for the offence under Section(s) 147, 148, 149, 323, 341, 324, 307, 354, 379, 448, 380 and 504 Indian Penal Code.

Counsel for the petitioner submits that petitioner is in custody since 25.06.2018. He has clean antecedents. There is land dispute between the parties. There is case and counter case due to aforesaid land dispute. Petitioner has also filed a case against the Informant and others vide Laukahi P.S. Case No.211 of 2017.

In the instant case, allegation against petitioner is of

Patna High Court Cr.Misc. No.59340 of 2018 (2) dt.06-10-2018 2/2 causing injury to informant with farsa on the head, which also hit in the leg of the informant.

Injury report of the informant is enclosed as Annexure-4, which shows that injury on head was simple in nature. Another injury was fracture of fibula and tibia, which was opined by the doctor to be grievous in nature. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Jhanjharpur, Madhubani, in connection with Laukahi P.S. Case No.210 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
