JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-08-2019 This is an application for grant of anticipatory bail in connection with Amarpur P.S. Case No. 545 of 2016, disclosing offence under Section 392 of IPC.
Prosecution story is that informant while returning after delivering the sand, three unknown persons intercepted his on the point of weapons and snatched Rs.20,000/- and a mobile phone of Micromax company with sim. Petitioner is not named in the F.I.R., but it transpired later on that mobile was recovered from one Munna Singh, who is father of the petitioner and he has disclosed the name of the petitioner as an accused. Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against him and he has falsely been implicated in this case. Further submission is that EMI of the looted mobile does not tally with

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that his name transpired on the confessional statement of his father and the investigation is still going on.
Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail.
