Writ application has been filed for payment of retiral dues including GPF arrear of gratuity, earned leave and arrear of salary from 01.01.2008 to 30.06.2008.

A counter affidavit has been filed on behalf of the State in which in paragraph-6 , it has been categorically stated that the earned leave for ten months and difference amount of gratuity has already been paid to the petitioner vide District Order No.07/2019 as Annexure-A to the counter affidavit. Similarly, the difference of earned leave amount for 300 days, i.e., Rs.93,530/- has also been ordered to be paid to the petitioner through District Order No.06/2019. It has further been submitted that the payment of his salary for the period of suspension a sum of Rs.42,180/- has

Patna High Court CWJC No.9938 of 2017(4) dt.03-07-2019 2/2 been ordered to be paid to the petitioner and Treasury challan to this effect has been issued and the only remaining grievance of the petitioner is with regard to payment of GPF which could not be paid due to non-availability of the details of monthly deduction of his GPF at different place which are being collected and the same shall be paid to the petitioner within a very short period.

In the aforesaid facts and circumstances, this petition is disposed of with a liberty to the petitioner to file a representation before the respondent no.2, Superintendent of Police, Supaul, District-Supaul for payment of GPF to the petitioner. If such representation is filed, the same shall be disposed of within a period of four months from the date of filing of such representation by a reasoned order and admissible dues of GPF shall also be paid to the petitioner within the aforesaid period.

With the above observation and direction, this writ application is disposed of.
