For the Opposite Party : Mr. D.P.Tiwary(App) ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 10-03-2015 This application is filed for grant of anticipatory bail to the petitioner in connection with N.D.P.S. Case No.26 of 2010 arising out of Gaya Rail P.S. Case No.148 of 2010 for the offences punishable under Sections 328, 379 and 411 of I.P.C. and 21/22 of N.D.P.S. Act. Prayer for bail made in the above mentioned case was rejected by the court of Additional Sessions Judge 1st, Gaya through order dated 13.10.2011. Hence, this application for grant of bail under Section-439 & 440 of Cr.P.C.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

On 7.3.2012, this Court called for a report from the court of learned Additional Sessions Judge 1st in connection with N.D.P.S. Case No.26 of 2010 arising out

Patna High Court Cr.Misc. No.3464 of 2012 (3) dt.10-03-2015 2/2 of Gaya Rail P.S. Case No.148 of 2010. Three years have elapsed. Learned counsel for the petitioner submits that he is not posted with the relevant information. Be that as it may, in case the N.D.P.S. case is still pending against the petitioner, he shall be released on bail upon furnishing the bail-bonds of Rs.10,000/- (ten thousand) along with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 1st, Gaya in connection with N.D.P.S. Case No.26 of 2010 arising out of Gaya Rail P.S. Case No.148 of 2010. He shall also report to the police station concerned on the 1st Sunday of every month, till the disposal of the case. In case the trial is not pending, none of these conditions shall apply.
