The petitioners being mother and married sister of the husband of the complainant are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323,498A and 379/34 of the Indian Penal Code. The accusation is of inflicting torture by way of demanding dowry and driving out the complainant from the matrimonial house.
Patna High Court Cr.Misc. No.26013 of 2015 (2) dt.01-07-2015 2/2 It is submitted that thrust of accusation is against the husband of the complainant. The complainant earlier also filed Complaint Case No. 263 of 2007 with similar accusation which ended into compromise. The petitioner no. 1 is old lady whereas petitioner no. 2 resides at her matrimonial house. Considering the aforesaid submissions, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.DJ.M., Nawada in connection with Complaint Case No. 920 C of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
