The petitioner seeks bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 150 litres country made liquor was recovered from a car. It is contended that nothing has been recovered from the conscious possession of the petitioner and the petitioner has falsely been implicated in this case. Petitioner claims that he is having clean antecedent and is in custody since 27.07.2018.

Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten

Patna High Court Cr.Misc. No.59115 of 2018(2) dt.06-10-2018 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge- VIcum- Special Judge (Excise) Nalanda at Biharsharif in connection with Giriyak P.S. Case No. 285/18. Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
