2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 378, 379, 411,34 of the Indian Penal Code and sections 11/56 of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation & Storage) Rules.

3. As per the prosecution case, petitioner caused revenue loss of Rs. 22,133/- to the Mining Department.

4. Learned counsel appearing for the petitioner submits that the petitioner has already deposited the said amount to the Mining Department vide annexure P-3. Petitioner claims clean antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of

No.55543 of 2023(3) dt.04-09-2023 2/2 arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Barh in Hathidah Police Station Case No. 47 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
