The petitioner seeks bail in Town P.S. case No. 406 of 2018 registered under Section 401, 379 of the Indian Penal Code.

The informant alleged that he sat on an auto rickshaw bearing registration No. BR06PD-6003 with his wife and children but other co-passengers committed pick pocketing and took out Rs. 33,000/- from his possession.

The learned counsel for the petitioner submits that name of the petitioner figured in the case on the basis of statement of Surendra Sah, driver of auto rickshaw but Surendra Sah has already been granted bail by this court vide order passed in Cr.

Patna High Court Cr.Misc. No.59968 of 2018 (2) dt.28-09-2018 2/2 Misc. No. 51963 of 2018. The case of petitioner stands on better footing.

Taking into consideration the facts aforesaid, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Town P.S. case No. 406 of 2018.
