The petitioner apprehends arrest in a case registered for the offence punishable under sections 420/34 of the Indian Penal Code.
Prosecution case is that petitioner is deed writer and he induced the informant to purchase the land of co-accused Arvind Singh though the said land was in the name of Bihar Government.
Learned counsel for the petitioner submits that the petitioner is merely a deed writer and not the vendor or the vendee and he is no way concerned with the transaction of the land in question. Petitioner has also returned Rs.10,000/- to the
Patna High Court CR. MISC. No.62405 of 2021(4) dt.14-07-2022 2/2 opposite party no.2 through UPI. Agreement in this regard was entered between the complainant and said Arvind Singh, as such, petitioner has played no role in the sale and purchase of the land. Petitioner has got no criminal antecedent. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the JMFC, Gaya in Complaint case no. 1784 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
