The present petition has been filed for modifying the order dated 22.05.2023 passed in Criminal Misc. No. 57049 of 2022, by which though the petitioner has been granted the privilege of anticipatory bail, however, subject to him producing proof of deposit of a sum of Rs. 3,00,000/- with the Nazarat of the learned Civil Court at Samastipur within a period of eight weeks, however, it is submitted by the learned counsel for the petitioner that though the said sum of Rs. 3,00,000/- has already stood deposited on 18.07.2023 but after a delay of one day, hence the time granted to the petitioner to deposit the aforesaid sum of Rs. 3,00,000/- be extended up to 18.07.2023 and the petitioner be directed to be released on anticipatory bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the averments made in the present petition, I deem it fit and proper to modify the aforesaid order dated 22.05.2023 to the extent that the time granted to the petitioner to deposit a sum of Rs. 3,00,000/- shall stand extended up to 18.07.2023, the date on which the petitioner has already deposited a sum of Rs. 3,00,000/- before the Nazarat of the learned Civil Court at Samastipur. Consequently, the time granted to the petitioner to surrender and avail the privilege of anticipatory bail is also extended by a further period of four weeks from today. The rest of the order dated 22.05.2023 shall remain as it is.

The petition stands disposed off with the aforesaid modification in the order dated 22.05.2023 passed in Criminal Misc. No. 57049 of 2022.
