2. The petitioner is apprehending arrest in connection with Chand P.S. Case No. 201 of 2026 lodged on 22.05.2026, for the offence punishable under Sections 126(2), 115(2), 117(2), 109, 352, 351(2) and 3(5) of B.N.S.
3. Prosecution case, in brief, is that, when son of the informant went to start the water tank, then the daughter of one Pramod Singh started abusing him. Upon the intervention of the informant and her husband, Satyam Singh allegedly assaulted the informant's son with a goji(stick), causing head injury. It is further alleged that Pramod Singh assaulted the informant with danda and her right hand got fractured.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No. 52051 of 2026(2) dt.29-07-2026 2/3 petitioner is innocent and has falsely been implicated in this case. Counsel further submits that the petitioner and the informant are agnates. Counsel also submits that injury report shows that the injuries were simple in nature.
5. Learned APP for the State vehemently opposes the prayer for bail of the petitioner.
6. Having heard the parties and taking into consideration that injury is simple in nature, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st, Kaimur at Bhabua in connection with Chand P.S. Case No. 201 of 2026 , subject to the conditions as laid down U/s 482(2) of the B.N.S.S., 2023 and also subject to the following conditions:
(I) One of the bailors shall be the petitioner's own or close member.
(II) The petitioner shall appear on each and every date fixed during the trial and also co-operate in the process of trial. (III) The petitioner shall not tamper with the
Patna High Court CR. MISC. No. 52051 of 2026(2) dt.29-07-2026 3/3 prosecution evidence or influence/intimidate any witness during the course of trial.
(IV) The Petitioner shall not commit offence of a similar nature in future.
In case of violation of any of the aforesaid conditions, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
