The petitioner seeks bail in Sakra P.S. Case No.156 of 2017 registered under Sections 25(1-B)A, 25(1-A), 25(1-AA), 25(1-AAA), 26(2), 27(2), 35 of the Arms Act, 3⁄4 of Explosive Substance Act and 16, 17, 18, 20, 22 and 23 of U.A.P. Act. Nine cartridges were recovered from the possession of the petitioner. Prayer for bail of the petitioner was earlier rejected vide order dated 16.04.2018 with an observation that the petitioner may renew his prayer for bail after framing of charge. It is submitted that charges have not been framed but similarly situated accused persons namely, Ganesh Rai has been granted bail. Only nine cartridges are said to have been recovered from the possession of the petitioner and for that, petitioner is in
Patna High Court Cr.Misc. No.58653 of 2018 (2) dt.20-09-2018 jail since 13.05.2017. Petitioner has already remained in jail for one year and four months.
Considering the facts aforesaid, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Sakra P.S. Case No.156 of 2017.
