2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per F.I.R., 11.01 liters of country-made liquor was recovered from the roadside.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the conscious possession of petitioner. Name of the petitioner transpired on the basis of disclosure made by the co-accused persons namely Mohti Kumar Singh and Rahul Kumar. Petitioner has got three criminal antecedents of similar nature.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts & circumstances and the criminal antecedents of the petitioner, this application is dismissed.
