Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 147, 148, 149, 323, 324, 326, 307, 449, 380, 436 of the Indian Penal Code.
This is case of misuse of privilege of bail.
Submission is that this is first misuse.
Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in
Patna High Court Cr.Misc. No.57030 of 2018 (2) dt.20-09-2018 2/2 connection with S.Tr.No.737 of 1994 arising out of Araria Police Station Case No.390 of 1992, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
If the petitioner would default in future, the learned court below would be at liberty to conclude the trial, keeping the petitioner in custody.
