Petitioner seeks bail in connection with Nanpur P.S. Case No. 75 of 2018 registered for the offence punishable under sections 302 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel appearing for the petitioner submits that merely on confessional statement of co-accused, petitioner has falsely been implicated in this case. Petitioner is not named in the F.I.R. and there is no eye witness of the occurrence. Moreover, similarly situated co-accused has been granted bail (Annexure-2) by a different Co-ordinate Bench of this Court vide order dated 17.07.2018 passed in Criminal Misc. No. 29340 of 2018. Petitioner has no criminal antecedent and is in custody since 06.07.2018.
