JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 11-11-2016 The present writ petition has been filed by the petitioner for payment of G.P.F. amount for the period 24.4.1971 to 11.4.1979, during which period, the petitioner was posted as an Assistant Teacher in the Patna District.

It is submitted that the petitioner retired from service on attaining the age of superannuation on 31st of January, 2002. He has filed several representations for payment of the Provident Fund amount for the aforesaid period and the last representation was made on 4th of January, 2012 in this regard as contained in Annexure-I to the writ petition. It is contended that on retirement, the petitioner received all the post retiral benefits including G.P.F. amount for the

Patna High Court CWJC No.9579 of 2012 dt.11-11-2016 2/2 period 1979 to 2002 but he could not be paid certain amount of G.P.F. for the period 24.4.1971 to 11.4.1979 when he discharged his duty in the Patna District.

In reply, learned counsel for the State has submitted that on receipt of representation of the petitioner, the respondent District Programme Officer (Establishment), Patna, examined the matter and took steps for payment of due G.P.F. amount of the petitioner. He has contended that the total amount of Rs.46,077/- has already been paid to the petitioner pursuant to office order issued under the signature of the District Programme Officer (Establishment), Patna, vide Memo No. 7684 dated 26.11.2013. He has further contended that the aforesaid payment has also been made after calculating the interest of the due amount.

Regard being had to the stand taken by the respondent State which has not been disputed by the learned counsel for the petitioner, the application is disposed of as the grievance of the petitioner has already been redressed.
