ANJANA MISHRA ORAL ORDER 13-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Tr. No.3280 of 2015, arising out of Shikarpur P.S. Case No.423 of 2013, for allegedly having committed the offence under Sections 341, 323, 504, 506, 307, 384, 387/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that initially the petitioner was named in the F.I.R. as one of the brothers who had made an alleged demand of Rangdari, yet on investigation the petitioner was not sent up for trial whereas the other brother was chargesheeted. Learned counsel for the petitioner further submits that later on the learned Magistrate

Patna High Court Cr.Misc. No.31711 of 2015 (2) dt.13-08-2015 2/2 has taken cognizance and as such, the petitioner is apprehending his arrest.

Considering the aforementioned submissions and also the fact that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Tr. No.3280 of 2015, arising out of Shikarpur P.S. Case No.423 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
