JUSTICE SUDHIR SINGH ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with a case registered under Sections 188, 272 and 290 of the Indian Penal Code and 47 of Bihar Excise (Amendment) Act.

The allegation against the petitioner is that 59 pouch of country made wine have been recovered from the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.09.2016. The petitioner has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering with the witnesses alleged against the petitioner. Nothing incriminating article has been recovered from the possession of the petitioner. The alleged recovery has been made from the possession of Goutam Rishi.

Patna High Court Cr.Misc. No.50298 of 2016 (2) dt.22-11-2016 2/2 On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Kahalagaon (Ghogha) P.S.Case No. 309/2016.
