The petitioners seek bail in a case registered under Sections 341, 323, 354(B), 436 & 34 of the Indian Penal Code. The prosecution case in short is that co-accused Laltu Sah put fire wood near the house of informant and on protest, the accused persons dashed her on earth and made her naked. It is also alleged that the accused persons set fire in her house as a result of which, her house burnt.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no

Patna High Court CR. MISC. No.50062 of 2019(2) dt.09-08-2019 2/2 allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 03-04-2019. Charge sheet has already been submitted. The court below differed with the said police report and took cognizance for an offence under Sections-354(B) and 436 of the Indian Penal Code. The allegation, made in the FIR is denied by the petitioners.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Manjhaul at Begusarai in connection with Cheriya Bariyarpur P.S.
