However, learned AC to GP 15, appearing on behalf of the respondents, has been heard.
2. In compliance of the order dated 05.11.2009, a counter affidavit has been filed on behalf of the respondents on 08.02.2010 after service of its copy upon the learned counsel appearing on behalf of the petitioner.
3. Learned State counsel submits that for the same relief, the petitioner had moved earlier this Court in CWJC No. 14623 of 2006, which was finally disposed of with certain direction by a Bench of this Court by order dated 31.08.2009 (Annexure-A to the counter affidavit). It is contended that the second writ petition in the same subject matter on the same set of facts is not maintainable.
4. Learned State counsel appears to be correct.

5. In that view of the matter, the present writ petition has to fail and is, accordingly, dismissed.
