The petitioners apprehend their arrest in Govindpur P.S. Case No. 83 of 2021, registered for the offences punishable under Sections 302, 201, 120(B) of the Indian Penal Code. As per the prosecution case, petitioners along with other co-accused persons named in the FIR in a planned manner committed murder of the brother of informant. It is submitted that there is long standing family dispute between the parties. Five days back earlier to this occurrence, co-accused Dular Yadav had threatened the brother of informant to kill. Petitioners have been made accused in this

Patna High Court CR. MISC. No.62122 of 2021(3) dt.25-07-2022 2/2 case only on suspicion. Moreover, informant is not eye-witness to the occurrence. Altogether fourteen persons have been made accused in this case. During course of investigation, no direct or indirect material has come against these petitioners. Petitioners claim clean antecedent.

Counsel for State however vehemently opposed the prayer for bail and submitted that there is accusation of committing murder of the brother of informant by sharp cutting weapon against these petitioners along with others and concealing the dead body. The anticipatory bail applications of co-accused having similar allegation have been rejected by this Hon'ble Court.

Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioners above-named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
