Petitioner is languishing in judicial custody since 26.06.2018 in connection with Kursakanta P.S. Case No. 142/2018 for offences punishable under Section 295-A of the Indian Penal Code and Section 67 of the Information Technology Act, 2008.

The prosecution case, as lodged by the informant, is that in the Whatsapp group the petitioner had posted some objectionable photograph of Indian Deity.

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and is languishing in judicial custody for more than three months. He submits that he has been falsely implicated in the case and has

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-V, Araria, in connection with Kursakanta P.S. Case No. 142/2018.
