Having regard to the nature of allegation against the petitioners for offence under Section 147, 148, 149, 323, 384, 387,

Patna High Court Cr.Misc. No.2508 of 2015 (4) dt.19-05-2015 435, 427 of the Indian Penal Code and Section 27 of the Arms Act and the fact that the petitioners with others had brutually assaulted a business entrepreneur setting up a sugar mill, this Court is not inclined to grant privilege of anticipatory bail to them. Accordingly, the prayer for anticipatory bail of the petitioners, namely, Nanhak Rai, Jokhan Rai @ Jokha Rai, Arvind Rai, Shatrughan Rai, Subhash Rai and Munna Rai is hereby rejected.

If the petitioners, however, would surrender before the court below and make a prayer for grant of regular bail, the same shall be decided on merit, preferably on the same day, without being prejudiced by this order.
